1. Terms of Use

Welcome to Bum Bargains. These Terms of Use ("Terms") govern your use of the Bum Bargains website, WhatsApp service, and any related features (together, the "Service"), operated by Wedgy Tech (Pty) Ltd ("Bum Bargains", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1.1 What Bum Bargains is

Bum Bargains is an independent price-comparison and price-alert service for nappies (diapers) sold by third-party South African retailers. We collect and display pricing information, calculate a cost-per-nappy figure, and let you view or receive alerts about lower prices. We are an information service only. We do not sell nappies, we do not hold stock, and we are not a shop.

1.2 We are independent of the retailers

Bum Bargains is not affiliated with, endorsed by, or sponsored by any retailer we track, including Checkers, Pick n Pay, Dis-Chem, Clicks, Takealot, or Amazon. All retailer names, logos, and trademarks belong to their respective owners and are used only to identify where a price was found. Your dealings with any retailer are solely between you and that retailer.

1.3 Pricing information and disclaimer

This is important, so please read it.

  • Prices shown on the Service are collected from third-party retailer sources by automated means and are provided "as is" and for general information only.
  • Prices change often and may be inaccurate, out of date, or unavailable by the time you view them. We do not guarantee that any price is current, correct, or the lowest available.
  • A price marked as "cheapest" reflects only the retailers and products we track at the time of collection. It is not a promise that no cheaper option exists.
  • Always confirm the final price, pack size, availability, and any delivery cost on the retailer's own website before you buy.
  • All prices are in South African Rand (ZAR) and, unless stated otherwise, exclude delivery fees charged by the retailer.

To the extent permitted by law, we are not liable for any loss arising from your reliance on pricing information displayed by the Service.

1.4 Purchases are made from the retailer, not from us

When you click through to a retailer, any purchase is a contract between you and that retailer, governed by their terms, pricing, payment, delivery, returns, and refund policies. Bum Bargains is not a party to that transaction, does not process those payments, and has no control over stock, fulfilment, delivery, or refunds for products you buy from a retailer.

1.5 Eligibility and accounts

You must be at least 18 years old and able to enter into a binding agreement to use the Service. You agree to provide accurate information (such as your email address, WhatsApp number, and your baby's nappy size or birth month) and to keep it up to date. You are responsible for activity that takes place through your account or WhatsApp number.

1.6 Free Service and future paid features

Bum Bargains is currently free to use. Creating an account gives you full access to price tracking, comparisons, and alerts at no cost, no card required.

  • We may introduce paid features, or change what is included in the free Service, at any time. Any paid feature will be clearly marked before you are charged.
  • If we do introduce paid features, they will be billed through our payment processor, Paystack, and we do not store your full card details, that data is handled by Paystack, our PCI-compliant payment processor.
  • We may change what is free or paid by giving you reasonable notice before the change takes effect.

1.7 Alerts and communications

Daily price alerts are part of the free Service, delivered by WhatsApp and/or email based on your preferences. By creating an account, you consent to us contacting you for that purpose. Your use of WhatsApp is also subject to WhatsApp's and Meta's own terms. You can turn off alerts at any time from your account settings. Message availability depends on third parties (WhatsApp, Meta, and mobile networks) that we do not control.

1.8 Acceptable use

You agree not to: (a) copy, scrape, harvest, or resell data from the Service; (b) use the Service unlawfully or to infringe anyone's rights; (c) interfere with or attempt to gain unauthorised access to the Service or its systems; or (d) use automated means to access the Service except as we expressly permit.

1.9 Intellectual property

The Service, including its design, text, branding, and the way we present and calculate pricing, belongs to us or our licensors and is protected by law. We grant you a limited, personal, non-transferable right to use the Service for your own non-commercial use. Retailer and brand trademarks remain the property of their owners.

1.10 Third-party links and services

The Service links to and relies on third parties (retailers, WhatsApp, Meta, our payment processor, and hosting providers). We are not responsible for the content, products, policies, or availability of third-party services.

1.11 Disclaimers

The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that any information (including pricing) is accurate or complete. Nothing in these Terms excludes or limits any rights you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded.

1.12 Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, or for any loss arising from reliance on pricing information or from your dealings with any retailer. Where we are found liable despite the above, our total liability is limited to the amount you paid us for the Service in the 3 months before the event giving rise to the claim. This clause does not limit liability that cannot be limited under South African law.

1.13 Indemnity

You agree to indemnify us against claims, losses, and costs arising from your breach of these Terms or your misuse of the Service, to the extent permitted by law.

1.14 Suspension and termination

We may suspend or end your access to the Service if you breach these Terms or if we stop offering the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination (for example intellectual property, disclaimers, and limitation of liability) will continue to apply.

1.15 Changes

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date, and material changes will be communicated where reasonable. Continued use of the Service after changes means you accept them.

1.16 Governing law

These Terms are governed by the laws of the Republic of South Africa, and you submit to the non-exclusive jurisdiction of the South African courts. If any provision is found unenforceable, the rest remains in force.

2. Privacy Policy (POPIA)

This Privacy Policy explains how Wedgy Tech (Pty) Ltd ("we", "us") collects, uses, and protects your personal information when you use Bum Bargains, in line with the Protection of Personal Information Act 4 of 2013 (POPIA).

2.1 The information we collect

  • Contact and identity details: your email address, WhatsApp number, and any name you give us.
  • Baby profile details: your baby's nappy size and/or birth month, which you provide so we can personalise alerts. This is limited to what is needed to send relevant prices.
  • Subscription and payment details: your plan and billing status. Card payments are processed by our payment processor; we do not store your full card number.
  • Usage and technical data: how you interact with the Service, device and browser information, IP address, and (where used) cookies and analytics identifiers.
  • Communications: messages you send us and your alert preferences.

2.2 How we collect it

We collect information directly from you (when you sign up, set preferences, or message us on WhatsApp), and automatically through your use of the site (cookies and analytics).

2.3 Why we process it, and our lawful basis

We process your information to:

  • provide the Service, including comparing prices and sending the alerts you request (performance of our agreement with you);
  • personalise the prices and alerts to your baby's size (your consent and our agreement);
  • manage billing and subscriptions (performance of our agreement, and legal obligations such as tax records);
  • provide support and respond to you (our legitimate interests and our agreement);
  • improve and secure the Service (our legitimate interests);
  • send you direct marketing where you have consented (see below); and
  • comply with the law.

2.4 Direct marketing and consent (POPIA section 69)

We do not currently send direct marketing emails or messages. The only messages you receive are the daily or weekly price alerts you signed up for, and essential account notices. You can turn off price alerts at any time from your account settings, or by emailing privacy@bumbargains.co.za. Withdrawing consent does not affect processing that already took place.

2.5 Children's information

The Service is intended for use by adults (parents and guardians aged 18 or older). The only information relating to a child is the limited baby-profile data you choose to provide, and by providing it you confirm you are the parent or guardian and consent to us processing it for the purposes above.

2.6 Who we share it with

We share personal information only with parties that help us run the Service ("operators"), under appropriate agreements:

  • WhatsApp / Meta, to deliver messages you have asked to receive;
  • our payment processor (Paystack), to handle subscriptions;
  • our hosting and cloud providers, to run the Service;
  • our email and analytics providers, to send messages and understand usage.

We do not sell your personal information. We may disclose information if required by law or to protect our rights.

2.7 Cross-border transfers (POPIA section 72)

Some of our operators (for example WhatsApp/Meta and certain cloud providers) may process your information outside South Africa. Where this happens, we take reasonable steps to ensure the information is protected by comparable safeguards, as required by POPIA.

2.8 Security

We apply reasonable technical and organisational measures to protect your information against loss, unauthorised access, and misuse, as required by section 19 of POPIA. No system is completely secure, and we cannot guarantee absolute security.

2.9 Retention

We keep your information only for as long as needed to provide the Service and to meet legal, accounting, or reporting requirements. When you close your account or ask us to delete your data, we will delete or anonymise it unless we are required to keep it.

2.10 Your rights under POPIA

You have the right to: access the personal information we hold about you; ask us to correct or delete it; object to processing (including direct marketing); and complain. To exercise these rights, contact our Information Officer at privacy@bumbargains.co.za.

You may also complain to the regulator:

2.11 Cookies

We use cookies and similar technologies to keep you signed in, remember preferences, and understand how the Service is used. You can control cookies through your browser settings. If we use non-essential cookies (such as analytics or advertising), we will ask for your consent through a cookie banner. See the Cookie Note below.

2.12 Changes and contact

3. Service Delivery Policy

Because Bum Bargains is a digital service, this policy explains how the Service is "delivered". We do not sell or ship any physical products.

3.1 What we deliver

Bum Bargains delivers digital access only:

  • Creating an account is free and gives you immediate access to the Service, price tracking, comparisons, and alerts, at no cost.
  • Price alerts are delivered by WhatsApp and/or email based on your preferences. Delivery depends on third parties (WhatsApp, Meta, email providers, and mobile networks) and cannot be guaranteed at an exact time.

3.2 Nappies and other products

Any nappies or products you see on the Service are sold and delivered by the third-party retailer, not by us. Delivery, collection, timing, and costs for those products are governed entirely by the retailer you buy from. We do not ship, deliver, or handle any physical goods.

3.3 If access is not delivered

If you created an account and did not receive access, contact support@bumbargains.co.za and we will restore it.

4. Refund & Cancellation Policy

Bum Bargains is currently a free Service, so this policy does not apply to anything today. It is kept here for if and when we introduce a paid feature, at which point it would apply only to that paid feature's fee. It does not apply to nappies or products you buy from a retailer. For those, the retailer's own refund and returns policy applies, and you must deal directly with them.

4.1 7-day money-back guarantee

If you are not satisfied, you can request a full refund of your first payment within 7 days of subscribing by contacting support@bumbargains.co.za. This is offered in addition to, and satisfies, any cooling-off right you may have under the Electronic Communications and Transactions Act.

4.2 Cancelling your subscription

You can cancel at any time from your profile page, or by emailing support@bumbargains.co.za. When you cancel:

  • your paid access continues until the end of the current billing period; and
  • your subscription does not renew for the next period.

4.3 Refunds

  • Outside the 7-day money-back guarantee in 4.1, we do not offer refunds for partial billing periods once a period has started, except where required by law or where we failed to deliver the paid Service.
  • If you were charged in error, or paid but could not access the Service, email support@bumbargains.co.za and we will refund the affected amount.
  • Approved refunds are made to your original payment method as soon as Paystack processes them, typically within a few business days, subject to Paystack's own settlement timelines.

4.4 Failed payments

If a subscription payment fails, we may retry it and/or suspend paid features until payment succeeds. Your data is retained during this period unless you ask us to delete it.

  • Essential cookies needed to run the site and keep you signed in.
  • Preference cookies to remember settings such as your baby's size.
  • Analytics cookies (if enabled) to understand usage and improve the Service.
